Legal Question in Personal Injury in Illinois

2 Questions:

1. I have been handicaped for 2 years. My handiicap is due to the poor management of property. I fell into a hole and subsequently injured my ankle/knee and then developed blood clots in leg, then lungs and now arm. I would like to know if I can sue them for that?

2. For close to 2 years I have asked them to fix my parking space. It consists of 4 parking spaces all are not level. My space is so bad that it is genereally in water as well as when you open the driver door it slams into the neighbors car. I have checked my local township for codes/ordinance and they state that this is private property. We file our taxes as a coporation. Can you help me?

You may be able to bring a claim, but it depends on several factors - when did the accident occur? Illinois law provides for a 2 year statute of limitations on personal injury claims. You indicate that you have been handicapped for two years as a result of this incident. Unfortunately, although it sounds like you may have had a decent case against them (assuming they had notice of the hole), Illinois only provides for a two year statute of limitations for personal injury cases. If it has not yet been two years since the incident occurred, I would speak with an attorney quickly about the facts so that if the facts of your case seem to lead to possible liability on the part of the owners, a suit can be brought before the limitation period expires (if it has already, there is nothing you can do).

With regard to your second question, you may be able to sue the owner for equitable relief and seek an order forcing them to alleviate the situation. I would suggest consulting with an attorney in your area to further discuss your options in this regard.

There are many questions that need to be answered in order to properly and accurately provide you with an opinion.

Among them are as follows:

1) IS this commercial property, industrial or residential?

2) Exactly what date did this happen?

3) Were you leaving or going to work at the time, or doing something work-related?

4) Has a doctor told you that the subsequent blood clots were caused by the fall, or was the fall an aggravation of an exiting underlying vascular condition that had not bothered you before?

Did your injury occur at night or during the day, if at night, was the lightingh sufficient in your opinion?
