Legal Question in Real Estate Law in Illinois

My brother has been separated from his wife for approx 2 years they were married and living together for approx 3 years, they were not divorced, she died yesterday, she has a 20 year old son with another guy, her son did not live with her. My question is, does everything, including the house belong to my brother? They cannot find a will, her sons father changed the locks on the door and told my brother he cannot come in the house.
