Legal Question in Real Estate Law in Illinois

my grandfather died about 5 months ago and prior to that he lived in a nursing home, his live in girlfriend was informed by the nursing home that the house my grandfather owned need to be sold to pay the nursing home. SHE NEVER TOLD US THIS, we just found out that there is now a lien on the house from the nursing home. This lady just moved out of the house and left all the PAST DUE bills on the table to be paid, all the utilities that she used while she lived there she didn't pay nothing. Can we take her to small claims court to get the money from her?? If we would have know the house needed to be sold we would have done that and she wouldn't had a place to live.

I would bet that the lien came from the Illinois Department of Public Aid. But, just a guess.
