Hot water

I moved into a new apartment in August 2000. After one month of living here, I began losing hot water. I must constantly turn the water hotter when showering, and the hot water only lasts an average of 10 minutes. I have made three requests to fix the hot water problem, but they have not corrected the problem yet. I made a written request on 12/1/00, and they have yet to reply to my request. Are they required to provide hot water, or is this something I must fix myself?

As a general rule, the Landlord has to provide facilities with hot water. Your issue is however, whether or not the Landlord has to fix the hot water heater. this depends on your contract. If your contract is silent, then it is implied that the Landlord must fix all those things that are not of common wear and tear, such as light bulbs. You have done the right thing so far by writing a formal request to your landlord. however, it would be best to have the formal request sent by certified mail, return receipt requested. It might be possible for you to fix the hot water heater at your own expense and then recuperate from your Landlord the expenses and any other damages that you may have suffered. However, like I said before, the key is your contract, read it over very carefully, especially where it describes your duties and rights regarding maintenance and repairs. Good Luck.
