At this time, based on your statements, without a listing, I would say that there is not any responsibility. If there is any, it would be the tenant's actions that have created it. You should be careful to limit the agent's involvement and get this into the hands of your attorney to handle right away. Your attorney will probably include a representation in the contract that the buyer has not used a real estate agent and provide that if a claim is made for commission based on the buyer's actions, the buyer will be responsible for such commissions.
