Legal Question in Real Estate Law in Illinois

Tree Trimming

I have a neighbor who has two trees which hang over my fence, & drop several branches a week. He once told me if I needed to use his trimmer to trim any branches off the trees, to feel free to do so. These trees are basically useless trees, & they serve him no purpose. The little shade they provide is on my property, & causes me to have problems growing anything. I feel, however, they are ultimately his responsibility to take care of & maintain. Do I have the right to trim the trees, even if it means the entire tree? One of them is currently quite close to my roofline, & I would like to have it removed.

Re: Tree Trimming

You can trim the trees on your side of the fence - anything that protrudes onto your property - but he has the right to keep the trees - so, no, you cannot take the tree down even if you hate it!
