Legal Question in Tax Law in Illinois

taxes / constitution

ive been a parner in a llc for 7 yrs . , paid state taxes to IL. , Wis contacted me and said i owe them taxes , they went thru all 7 yrs tax returns and came to an ammount which i paid . IL will not refund 2 yrs of taxes stating ''statute of limitations '' thus forcing me to pay state taxes twice on the same money .... is this legal , it was my understanding that paying taxes twice on the same money was unconstitutional . what recourse do i have ?

Re: taxes / constitution

States impose tax based on where the income was earned.

I would have a tax attorney review your situation to determine whether WI has any valid claim to tax the income.

In addition, he can tell you whether WI is able to assess taxes for 7 years if there was no evasion involved.

Good luck to you. Let me know if I can assist.
