Legal Question in Traffic Law in Illinois

Registration & Insurance Citation - out of state now

The day before my boyfriend moved from Illinois to Oklahoma, he received a citation for expired registration and lack of insurance. He had insurance, but did not have the proof at the time. Now he is living in Oklahoma and his court date is April 11th in Illinois. His original court date was in February, but the attorney that agreed to work pro-bono for my boyfriend did not appear for the original date so the court date was pushed back. He called the court and they said it is a mandatory appearance and he cannot handle this by mail. We do not have the funds to hire an attorney and he isn't sure if he can get time off from work to go to Illinois to appear for his hearing. Does my boyfriend need representation or can this be handled by appearing in person, showing proof of insurance, and paying the fines? If he is able to get off from work, we are wondering at this point if it would be less expensive to purchase a plane ticket than hire an attorney.

Your boyfriend will probably have to both buy a plane ticket and hire an attorney. If he does not show in court his license will be suspended. That ruling would suspend him in OK, too. If you wish a free consultation, please call me.

It is mandatory that your boyfriend appear in court. If he does not, his license can be suspended, which can affect his driving privileges in Oklahoma as well due to interstate compacts. Therefore, I would advise that your boyfriend both appear, and hire an attorney. It is evident that this is too complicated for you to handle yourself. Too bad you didn't state in what county the charges where pending.
