What is the violation of the law if a will has not been filed after the death of a person.

A will must be filed within 60 days after death or the executor may be guilty of a class a misdemeanor. The penalty can be up to 364 days in the county jail, or fine of $2500, or a combination of both. Just because a will is filed it doesn't have to be probated.
