Legal Question in Wills and Trusts in Illinois

after probate

My father died eight months ago leaving me all real estate. My brother and sister received 80% of the money.

Probate six months has ended. Now I am told my sister and brother must sign a paper saying it is ok with them that I get the real estate. My sister has signed, but my brother is not happy about me getting the house and ground can he cause trouble now? How much longer will this take?

thank you, Carolyn

Re: after probate

If your father's estate has been in probate court, the court can compel your brother to sign the document.

If the will directed the property to you, and your siblings were compensated with other assets, there should be no legal objection your brother can have.

However, since there may be other facts that have not been included in your posted message, such facts may change the answer that I have given you here.

You should have your attorney (or the attorney for your father's estate) review the issue and determine what should be done.

Good luck to you.
