Legal Question in Wills and Trusts in Illinois

Ruling on Petition for Citation

A Petition for Citation was filed with the Court that contained a number of exhibits to support. The opposing party did not respond to the Petition. During the time the Petition should have been ruled on there was the rotation of Judges, and it has been forgotten. Can I write a letter to the judge or do I have to file a motion and if so How should I title the motion.

Re: Ruling on Petition for Citation

You don't say whether it was a Citation to Discover, or a Citation to Recover. There is a big difference.

For a Petition on a Citation to Discover, the opposing party doesn't have to respond, but on a Recovery Citation they do or else face being held in contempt of court.

It sounds like you might want to consult a lawyer on this one as Citation hearings can get rather complex.

Good luck to you.
