If you are involved in a traffic accident, not at fault during working hours, is it better to file a WC claim or file a claim with the guilty party's insurance co?

If you were injured while workring due to a third party's fault, you have two claims. Both can be pursued. WC claims deal with medical bills and wage loss. However, Third Party claims deal with pain and suffering and loss of normal life and any other items of damages.

There are limitations and caveats of which you need to be aware of--your best move is to hire an attorney to protect all your interests.

Both can and should be pursued. Definitely the wc claim because you don't have to prove fault, but also the third party claim as it can potentially be worth more. We can connecy you with the right lawyer for both cases. Feel free to call us at (800) 517-1614.
