Legal Question in Workers Comp in Illinois

lower back injury

About a year and a half ago i was working for an appliance delivery store. I was working in the warehouse and was stacking a washer on top of another when my back gave out, causing me to fall in pain. the owner of the company was standing right there when it happened, he ask if i was ok, i said no. my back popped 3 times when this happened. my boss allowed me one day off and never offered to send me to the docter, then about 6 months later he fired me. what can i do? i am 21 and i can't hardly sit down without being in pain, picking up my own children is so painful that i can hardly bare it.

Re: lower back injury

And you did not file a worker's compensation claim? You have been wronged. Your boss canno fire you because of your injuries if the injuries occured on the job. You are entitled to receive proper medical care, the WC insurance must pay for all your medical care, all your wage loss and a lump sum settlement for any temporary or permanent disability you have suffered.

You must get an attorney at once. If you are still hurting and are in need of medical care, you are entitled to compensation. As you say you were injured on the job, performing a job for your boss and there is no reason why you should not get properly compensated for the injuries you have suffered.

If I can be of more help, contact my office.

What you can do is have a free consultation on the phone or

in person with an attorney

who handles workers compensation cases.

Under Illinois law you are entitled to

a percentage of your wages during your

disability period, all of your medical expenses paid for necessary treatment

and a lump sum award based on any permanent condition you may have.

Further, you may have a civil claim for wrongful termination if your employer fired you based on your work related injury and claim for benefits.

Please do not hesitate to contact me for a no obligation consultation.
