worker comp and company buy out

I just had a spine fusion on 2 level, my doc and ime say i can,t work any more, how much should i ask for my buy out

The amount of the settlement depends on your wages, the percentage of your disability, and other circumstances surrounding your case. You should ask your attorney this question

If you do not have an attorney, you better get one because without one you will short change yourself in no time. There is simply no way you can go up against a season insurance adjuster who has been thought and knows all tricks to sell you short--that is what he/she does for a living.They get various training on this. They do it everyday.

I want to caution you that this is a serious situation which requires expertise and a lot more information than you have provided.

Looking online for an answer such as you desire, is like doing research on spine surgery - you can learn all you want but still should not do it alone.

Your question cannot be answered without about 30 to 45 minutes of communication in person, a review of the documents and an examination of your earning potential now and had the accident not happened.

To suggest otherwise would be cavalier.

From the sound of it, it appears you are trying to negotiate a settlement yourself.

This is not a good idea. Medicare may have a set-aside. And you may be entitled to benefits under the Act you are not claiming.

The amount of your settlement will depend on a number of factors including your ability to regain employment.

You have a very serious injury and there are many options for you to consider. You should consult with an attorney immediately.

Essentially, if your doctor is of the opinion that you cannot work, you are entitled to 2/3 of your average weekly wage for the rest of your life. The insurance company would prefer to settle now rather than pay you over your life, and I expect you might wish to have a lump sum now as opposed to weekly payments the rest of your life - especially considering we all do not know what the future holds.

In its simplistic form, as attorneys, we can compute your life expectancy, get what we call a "present cash value" of the total amount of your benefits and attempt to settle the case for that amount.
