I have given a cheque dated 1st of september 2009 if the payee is trying to get the cheque get paid before that what will happen

The Bank will not accept the cheque and if accepted by mistake will be returned as premature deposit

The cheque dated 1.09.2009 (?) cannot be presented to the bank for payment before that date; The Bank is not permitted to make payment prior to the date written by you on the cheque.

In other words, the banks are bound to honour the date written by the drawer on the cheque.

In your case, the payee cannot receive payment from the bank before the date mentioned by you on the cheque.

No Bank will honour or dishonour a cheque dated 01/9/2009 when presented before that date. If presented before that date, the cheque will simply be returned with an endorsement of present on due date.
