Cheque bounce

Hello,

We have given 1 lakh rupees as token amount for the housing purchasing, but due to some problem we have rejected to purchase the house, now we have demanded our 1 lakh rupees from him but he has given a cheque which is bounced and now he is not returning that amount, we want our 1 lakh amount + interest on it + notice & court fee . Could u please guide me , what we will do in that?

In the criminal case under Section 138 you can't demand interest , expenses as sought by you. But in Civil Case such remedies are available . You may go simulateously for 138 and Civil case and seek remedy . under fear of punishment the said party may compromise with you the matter
