Legal Question in Bankruptcy in India

cheque dishonored

I have given a cheque to a person, but i had to pay cash befor the date of cheque. sir that person dint give any proof for it. and he dint returned the cheque also. He produced the cheque in oct 2007 and it got dishonorednow. he have filed a case. Sir i have no proof to show my inocence. what should i do.

As there is no proof of payment I am of the opinion that you interact with the persona and meet a point of compromise.

Since you have no proof of payment, legally you are liable to pay him as your check has been dishonored. Try to explain in the court that you had already paid him in cash and he deposited the same amount in his bank. This may help you in pressuring this person.

Otherwise, the only way, at present, is to talk to this person and reach some sort of compromise with him.
