acceptance .

there's an agreement btw 2 parties.the buyer and the seller.the time period was decided but after a mnths time due to some reasons of the buyer's the performance got delayed n on the mutual understanding ,the performance was scheduled for some another time..performance again could not happen on the seller's behalf.another time period was scheduled n seller got the acceptance of the buyer...Now due to this what are the rights of the sller if the buyer sues him for non performance of the promise..what situation will the seller be in if he does.nt perform the promise which was accepted by him later on..

Both are bound/Either one may go to the court for specific performance by the other of the contract under the Specific Relief Act

the seller will probably at loss in the court cases if no written agreement was executed for delay of performance.
