Legal Question in Consumer Law in India

I have bought a flat in bengaluru. The commitment to complete the flat was 30.9.2012. The keys have been taken by me in May 2012. However, the building is still incomplete. The builder is slowly doing work and being huge apartment, may take few years to complete. I am intending to file Consumer case against the builder.

1. Being generally big people, can the builder trouble me and my family?

2. Will I really get justice if i proceed legally through consumer forum?

3. What could be the cost i am likely to incur in this process.

4. What proof do i need to submit to prove that the building is incomplete. Can i get help of a government architect to give a certificate on the status of completion?

The agreements between builder and yourself must be studied for a opinion on the course of action.

Broadly speaking, for delayed delivery os possession you can file Consumer Fora complaint for compensation. The cost for the case would be fees/ charges will be as discussed and settled.

You can follow the method you indicated as proof of incomlete status of your apartment.

Generally it is true that rich people have access to several top notch lawyers and use more than one legal processess that usually they end up defeating the poorer people. But it need not be the same for every such case. contact [email protected]
