cheque bounce

had paid a travel agent rs 11555 in nov for trip. he didnot provide accomodation or other facilities inspite of receiving full payment. he agreed to refund the full amount. he kept delaying for past 2 months saying sister died/father died. he finally gave a cheque which bounced. he is avoiding calls now. he has closed his shop too. i have his mobile number and vehicle number and payment receipts/copy of cheque. whats the legal procedure to recovery the money. i have been calling him/smsing/emailing for the past 2 months. he doesnt bother to call or reply. its been a real mental harrasment. this has happened in pune, india

File complaint u/s.138 NIAct on the basis of his last known address and also approach consumer court.

If u have got his address u may go for Section 138 of NI Act . If he is having property file a suit for recovery and get attachment upon his property u get the decree u can execute in Court

If within limitation, you can initiate criminal case u/s.138 NI.

You can also approach consumer forum for recovery of money.
