criminal law (vehicle stolen case)

A person being arrested in connection of vehicle stolen case but the section charge against him was 408 IPC(criminal breach of trust by the govt servant). Owner of the said vehicle lodge FIR against his driver but not against the arested person. The person being arrest is neither his driver nor his employer. In the meantime the vehicle was recovered along with the arrested person. the person was arrested on mere suspect and by occupation he is a cultivator.He is in the jail for 23 days.his wife on the other hand is carrying a baby and is at delivery state.

1. can i apply bail application?

2. on what ground he may get his bail?

3. i already applied bail in cjm but it was rejected?

4. if i filed bail application what will be the approvate ground to get bail.

Sir, i his brother is helpless in this case and so pray before you to show me a right path and guidance to get his bail and as he the only bread earner and the condition of his wife is in the last position for her delivery of baby and as reffered by the doctor is in critical position she need him. In this connection i am helpless. Sir please help me out.

have you told the cjm abt the delivery and have to attached the papers of her regarding this and it is a case of 411 against the arrested person only.

Apply for Bail in the Sessions Court.

You will need a local lawyer to file your bail application in the court of Sessions Judge.

You can file another bail application. If the police is filed charg sheet. Then he is entitled for bail. Contact you nearest lawyer.
