my client is transporter his driver took loaded tanker from mumbai to hyderabad in hyderabad he sold the costly oil from the tanker and ran away by leaving the tanker on road, our one driver saw that the company tanker lying that so he informed in company that empty tanker lying that so i with my client went to lodge the FIR but they refused to lodge FIr, so i wrote the letter to dcp, c.p, and c.p law and order but not any action taken by them what should i do, should i lodge to the magistrate and wht

If police is not taking any action, then you have option of approaching the concerned Magistrate by filing a complaint.

Since all the accused are not known, it will be a fit case for ordering investigation U/s.156(3) Cr.P.C.

Please remember, an order U/s.156(3) Cr.P.C. can be made only prior to taking cognisance of offence by the Magistrate.
