Divorce-non compliance to a decree of rights of conjugal rights

My husband has filed for restitution of conjugal rights.I am interested to get a dovorce from him.Life with him meant getting a black eye every second day.10 months we have been separated.

When is the right time to file for divorce?What do you suggest?

Shall I let a decree favourable to him be allowed exparte, not comply,wait for 1 year and then file a suit of divorce or shall I file for divorce now?

Is is true that if the decree is favourable to him then he wont have to pay any maintenence to me and my daughter?

Help plz.

Please do not be desperate and repeat your question coached in different wording.

You are entitled to pursue your remedy under DVA and cannot be deprived of maintenance for yourself and ur daughter just because of non-compliance of the restitution decree.
