girl child custody

I have a 11 yr old daughter and we will be going in for a mutual divorce. however, both of us want the custody of the girl child. Can you tel me who can win this?

There is no hard and fast rule as to who will retain the custody of the child, but the courts are generally inclined to give custody to the mother. However, the court to determine as to whom the custody be given, has to see as to who would be in a better position to upbring the child. If the court finds that father is in better position and child's future would be more secure and promising with father, then court may give custody to father, with visitation rights to the mother.

if you are geting a mutual consent divorce you both have to agree to the terms as per which teh divorc will be granted

the custody of the child would be granted to the parent who is capable of looking after the child in a positive manner from all aspects viz. financial, social, moral etc. you have not mentioned whether u a father or mother. normally the custody of 11 yr old girl would be granted to mother
