Legal Question in Family Law in India

Hi,

I have divorce case in india. Opposite party is interested only in money , harrase my parents and me.

I am IT professional.

I am right now at Singapore,

I am getting my Basic salary in INR 13000/- and remaining in Singapore Dollar $4000 (SGD), which is not too much as per Singapore living cost.

Now if i need to pay 1/3 of my income , what income would be consider ?

If Singapore income is consider than it is too less and only for Food,Travel and house not more than that.

If i settled out of india then 1/3 of what i need to pay ?

Out of court settlement is not possible.

There is no rule that you need to pay 1/3rd of your income. The amount is fixed by court based on income levels and proofs, wife's income and status of parties.

If you hire attorney and draft your response well, it may be possible to minimize even elimnate the need to pay.

You need to maintain your wife as per the "standard of living" she was enjoying at the time of separation. You may calculate accordingly and start providing her sufficient funds for her living.
