Legal Question in Employment Law in India

I am an employe of an MNC from 15 Jan 1992, who had a Liaison office in India till Jun 2003. The same MNC had another Limited company in India. On 1st Jun 2003, a new company is formed and the employees of the Liaison Office and the Limited copmpany are transferred to the new company, In the new appointment letter it was mentioned that for retirement benefit the 1st Jun 2003 will be considered.. At the time of transition employees were given a letter assuring that due to the transition there will not be any break in service of the copany. Now iam on superannuation, the company is not giving me the benefit of gratuity for the period of my service from 15 Jan 1992 to 1 Jun 2003( about 12 and half years). Please advise me the legal position.

Yes you can get all the benefits of gratuity and all others as per employer assurance, and you have also latter of assuring from your employer by this you can get all benefits as per law.
