Legal Question in Employment Law in India

My ex-employer is not paying salary, PF and gratuity.

Making all funny reasons saying that my performance was not good etc.

Can he stop my salary, PF and grautity.

Please help

Dear Sir / Madam,

No ... you have not mentioned the duration of your last employment and the fact whether you were on probation or were confirmed in the service of the Company, so as to enable me to guide you better. Salary is due for payment from the first date of employment till the last date of employment irrespective of confirmation. Employer's & Employees' Contribution to Provident Fund and Gratuity as deducted, is either settled and paid to the employee, or it is transferred to the new employer at the behest of the employee.
