Legal Question in Employment Law in India

Loss of job

I am 54 years of age, employed with a pvt ltd company for 2 & a half years, suddenly one day I am asked to quit the job same day without assigning any reason. The past record has been quite healthy. I worked with the same company for 3 years earlier also. The company requested me to come back & join them. Two times I was promoted also & there was no untoward incident or any other reason to the best of my knowledge. My notice pay & even part month's salary has not been paid to me. Can I stake any sort of legal claim for a suitable monetary compensation on account of my mental agony or for a VRS sort of thing at this age of 54, Please advise urgently.

Re: Loss of job

Your termination is legal.you can challenge your termination and can also claim compensation. However, your appointment letter and other relevant documents are required to be looked into for giving appropriate advise on the subject matter and if possible a personal meeting is needed.

Re: Loss of job

The terms and condition of your appointment are required to be seen.

If your termination is de hors the appontment conditions or agreement entered between you and your employer, then you can certainly claim compensation, damgages etc. Whether ur entitled to othe rbeneifts or not can be said only after perusing the full facts. VRS is govt. scheme and does not apply to private enterprise.

But if your job is quit by company then you cannot cliam re-appointment.

Re: Loss of job

You may challenged the termination which is wrong illegal against the provisions of law and claim all service benefit and compensation.

At this stage you cant think to take VRS as they already asked you to quit the job hence firstly you have to challenged the termination
