Resignation acceptance and relieving letter after serving 3 month notice period

ONGC Videsh Ltd is 100% subsidiary of Oil & Natural Gas Corporation Ltd(ONGC).

I had resigned form ONGC Videsh Ltd (OVL)-Delhi on 9th April and as service rule book I have to give them notice period of 3 month.

So I attended the office till 9th July06.

I had paid my outstanding dues as intimated to me by OVL on 10th May06.I had the receipt of payment with me.

OVL asked me to submit the passport I had submitted the same to them though I know my passport is my property but since they asked me in writing so I had submitted my passport to them

OVL never had any correspondence with me during this period.

When I was attending the office they had not given me any seat to sit in office neither they had given me any work during my stay in Delhi office. They had deleted my name form the list of ONGC videsh employee on web site also they had cancelled my official email address wef from mid May06.When I asked them why they told me this is ONGC procedure.So Ihad worked in OVL Delhi office without nay seat without any work till 7th July06(last working day of my notice period) . The attendance can be verified by smart card punching log sheet.

ONGC has not given me resignation acceptance letter and relieving letter on 7th July.WHAT TO

Dear Sir,

what you have done is absolutely as per the law. And they have no rights to retain your passport. I would advise you to issue them a legal notice at the earliest and upon their failure to reply go ahead and file a case.
