Legal Question in Employment Law in India

I have worked in a small company (total head count less than 15) from 3.5 years. It is going to be 10 months leaving the company. My 2 months salary is pending with the company and I am following my old boss from almost 10 months for the same. He has released only 10% of the total due salary in this period and just keep giving me dates saying he is going through the cash crunch and when he will be comfortable with the money, he will release my remaining salary. I am tired of calling him after every 3-4 days as he asks me to do.

Some time earlier when I said that I will go to labour court, he said that he will also go legal with the matter that I was not able to handle the projects and due to that company is bearing loss. (please note I was salaried, not a profit partner).

What should be my course of action? Can I go in labour court against him (or where should I go with the matter)?

serve a legal notice to him to pay the amount otherwise legal consequences will follow.after that u can go to labour court.if he will file matter for your incompetency he has to show that in court.so for nw serve a legal notice

serve him a legal notice for payment of your unpaid salary. In case issue is not solved then approach the labour court for appropriate action and recovery against him.
