Legal Question in Employment Law in India

I am working as a senior executive HR in a software company. Our company is intending to hire a senior developer in the organisation. The proposed candidate will be working from home in flexible hours. In this situation , I would like to know which option would be better � a regular employment or a Consultancy based asssignment? If the consultant raises invoice monthly, will there be any service tax that the company has to pay towards the consultation?

whether to employ full time or as a consultant to operate from home shall depend on the nature of work . However, in an IT industry noramlly the work taken up on project basis , therefore if you are highring some one for project or specific purpose then it is advisable that you take him as consultant. Service tax is applicable to consultants.
