I am buying a house (Without NOC) in ahmedabad. I paid Owner Rs. 51,000 in cash as Advance but now I know that this house in reserved under Govt. Plot. so in this condition what can I do to return back my Rs. 51,000 cash.

first thing u do is take consultation from a lawyer

if u executed any document at the time of giving cash then u can file suit for recovery otherwise it would become difficult to get back money

it is difficult to understand you question!

do you mean the plot was allotted to the owner under govt-plot?

where is the plot? who is the developing authority? does the owner have a sale deed?

we need to see the documents before giving opinion!

U repudiate the contract and serve ur seller a notice for the return of money stating that the plot has no good title.

I will presume that you have paid the amount of Rs. 51, 000/-at the time when the agreement of sale was executed. No advise is possible unless i go through the contents of the agreement. plz scan and send a copy of the agreement.

You may file a recovery suit against the seller.contact a lawyer.
