Legal Question in Personal Injury in India

Hi,

I had a family member death in an accident.(motorcycle)

Can we get Insurance Claim under MVCC(accidental claim) when my case /chargesheet is booked under IPC 304 (and not 304A) . The driver has been booked with intentional murder due to anger.

criminal case will run under the provisions of IPC but you can file your claim in a motor accident tribunal as well claiming compensation.
