Legal Question in Real Estate Law in India

fasle case.

I have been falsly suied 4 tresspassing & mense profit @ use & occupation charges.The plaint clearly alleges that I WAS IN POSSESSION SINCE LAST 4 YEARSwell within the knowledge of the plaintiff. Is the suit liable 2 b dismissed on account of limitation of 3 years by virtue of the limitation act?

Limitation for suit for possession on title is 12 years.

Being in the property for more than 4 years does not give you the title of the property and you doesnot become the owner of the suit property unless u have proper document of transfer in your favour. The limitation in this case will be 12 years from the day you deny the right of the plaintiff.

You should send us a copy of the plaint; In any case, since you have been served a copy of the plaint, you will need to file a reply. Better to engage a local counsel for preparation and filing of your written reply in the court taking all permissible pleas.
