Property Settlement

Hi.

I have a problem in my family where my grand mother�s sister has raised my brother(not adopted) and she has a small house in Hyderabad. She is unmarried and made no will. She is expired 6months back. My brother wants to own this house now.

We all the legal heirs want to settle this and get my brother the house. Out of 5 people, 4 stay in Bangalore. I heard about the Release deed that can be done, but only at Hyderabad where property is present. Is there any other way of getting this documented and my brother getting full rights of the house(not all going to Hyderabad). One of the heirs is notorious, so we want to make sure we have all the required documents signed from them before we pay them.

After the death of owner, his or her legal heirs become owner and have right to surrender their respective right by executing "Surrender or Relinquishment Deed" on favour of one or more people.

Necessary Documents can be executed in Banglore and a limited power of attorney for registration thereof can be given.

The legal heirs may execute the 'Relinquinshment Deed" at their respective places without visiting Hyderabad.

I would advise you to execute RELINQUISHMENT DEED at their local jurisdiction.
