Legal Question in Real Estate Law in India
I would like to know that in a society of 56 what ideally should be the maintenance charges?. Secondly in case if one member feels that the charges framed by the committee are high and should be reconsidered, and therefore he/she doesn't pay the maintenance charges what action the committee take against such member?

The maintenance charges depend on the actual recurring expenses to be incurred monthly and unforeceable expenses which cannot be ascertained now. You have to arrive at some figure based on both the above expenses and divide it among the total members. If anyone disagrees then the majority has to take a decision to make him accept it. Otherwise only alternative is to remove him from the membership and stop the services rendered by the society to him and his flat.
