Legal Question in Wills and Trusts in India

Hi ,

My grandfather migrated from pakistan and is Hindu. He got a house on compensation basis in India. The house is still in his name after his death.

My auntys showed us a WILL saying everything is given to them. Nothing is given to me or my dead father.

The WILL they shown is registered and the house is still in my grandfathers' name. Only "DEED OF CONVEYANCE" is available against this House.

Will this property be considered as my grandfathers' "SELF ACQUIRED" property or it is an ancesstoral property.

Is there any law in India which can prove this is ancesstoral property so that I can challenge WILL and get my share?

Please suggest any LAW for Migrated people(1947).

You need to contact a good lawyer, where you live. As far as the Will is concerned unless it is probated, it has no meaning, whether registered or not.

If it is not probated, you may apply for a succession certificate.
