Legal Question in Wills and Trusts in India

Is probate compulsary for a flat in maharashtra ?? Can the legal heirs sell their parent's property with out optaining probate ??? If there is no dispute then how long will probate case go on in the mumbai court ?? Kindly advise.

probate is compulsory in mumbai. time cannot be estimated.
