Re: Unpaid child support

Generally there are two ways to enforce a child support order. One is through the prosecutors office in Title IV D court. The other is with private counsel. While in the private sector, attorney fees may be sought from the party against whom the the order is to be enforced, no part of the actual support paid may be directly shared or paid to a third party. This money is intended only for the support of the child or childern named in the order. There have been instances where courts have reduced restitution orders to a judgement. These could then be pursued by a private collections operation. However, I do not believe the same can be done with a support order. It may require the state legislature to enable such. At this time, Iam not aware of that any such legislation exists.
