Legal Question in Credit and Debt Law in Indiana

I received a summons and complaint with a affidavit of indebtedness attached. The affidavit states my balance is $**.** as of 1/31/11 but it is signed 2/4/11. I date on the first bill from this collector is 1/28/11. Isn't it illlegal for them to try and collect from me prior to purchasing the bad debt?
