Legal Question in Criminal Law in Indiana

I will try to make this short. My sister died at her ex-husbands home . We the family know the ex did it. His drugs was found in her system. She didnt do drugs. She had alot of information she kept in a diary, on her ex-husband that could probably get him put away. the night she died the ex- took this book out of her car.He still has it .We was told by a recent ex-wife of this man that she seen the diary and he keeps it in his car locked up.She also told us some bad stuff he the ex admitted to her. Such as killing others and that he keeps little reminders from the victim's .People have told us that this man was at a party asking for drugs he could use to kill my sister with. He had threaten to kill her many times. We found out that he told a person 2 weeks before he killed her that he needed to get rid of her because she knew to much on him. So my question is how can we get this book (diary) from him? could the police have the right to search her car and home for this diary? being that it's evidence. And we have a witness to him having it. thanks
