Her Fault Divorce

My wife has cheated on me. I want out. What do I have to do to get out of the marriage? What, if anything, will it cost? What are my next steps? Will I have to pay anything other than legal fees?

Indiana is a no-fault divorce state. You don't have to drag each other through the mud in order to get a divorce here.

In Indiana, there is a 60-day waiting period. That means that that's the soonest that you can be divorced after the petition is filed.

Two ways to be divorced here: By settlement agreement/waiver of final hearing or by a final hearing.

If you can agree on the issues (most of the time this can be accomplished), then you memorialize the terms in settlement agreement, sign it, submit it to the court, which rubberstamps it and you are then divorced.

If your spouse is a horse's butt and you can't come to an agreement, then you would have to come to a final hearing.

Cost depends largely on how cooperative both parties are in reaching an agreement.

There's always a $107 filing fee that the petitioner will be responsible for.
