Legal Question in Family Law in Indiana

FIght or Flight

My ex-wife lives in Idiana, she has been married twice since our divorce (#4 and 5) within a matter of months. The current husband has a protective order keeping him away from his own son. He has fired a weapon at my ex-wife in my children's presence. He has been violent around them. She uses them as leverage to get what she wants. She lives in a double wide in rural IN, I have a nice home in VA.

I think if I sue for custody she will be shaken and may give me custody of the oldest (14) to avoid the high cost of fighting. I have seen how courts work with custody though, and I don't think I have enough leverage to get them out of there. They are being raised with poor morals and no concept of right and wrong. Should I fight, or will I just be wasting my money? More details are available if needed.

Who has jurisdiction now? i.e. which court entered the last order granting her custody? If it's Indiana, you've got to fight the battle there, with an Indiana attorney.

Also, does the 14 year old want to live with you? At that age, the wishes of the child are given weight, at least in Virginia.
