Employee Soliciting the Sale of RX Drugs

I received a complaint from an employee that they were approached by a co-worker and asked if they wanted to by Xanax from him. If the complainant doesn't want to sign a written statement and they wish to remain anonymous, what can I do legally to terminate the employee soliciting the sale of rx drugs on company premises and keep this employee's anonymity and avoid an EEOC complaint?

Yes, we have a substance abuse policy but it was just distributed on Oct. 5, 2006. The solicitation occured prior to the policy distribution and I believe that's why we have employees coming forward.

You definitely need to be careful here. If the witness will not swear to what he/she knows, then it has little evidentiary value. You should DEFINITELY seek legal counsel on this matter. This is not the place to resolve an issue like this. Too many sub issues, facts that need to be known, questions to ask, etc.
