Legal Question in Employment Law in Indiana

labor issue

I have filed a grievance stating that the company has violated the contract. It was in 2nd step. The same person who signed it from the company in 1st step was there. Is it illegal for the same person to be in each step. There was one other company personnel there above him. My union reps are not helping us very much. please help.

There are generally no rules as to who can or cannot be present from the company. They have the right to have whoever they want there to represent them, unless there is something specific within the union contract (which would be unusual).

As to the union not doing much to represent you, that is a common complaint and unfortunately, often occurs. As a one time member of a union (for 16 years), I understand how frustrating it can be at times. But realize, those stewards are often untrained and not well versed in the contract. My best suggestion is that YOU learn the contract and be prepared to represent yourself in there. The more you know, the more success you will have in grievances. Study the contract. Know your rights. DO NOT DEPEND ON THE STEWARD TO FIGHT FOR YOU. You do it. Trust me when I tell you: you'll do a far better job.
