Legal Question in Employment Law in Indiana

I submitted my 30 day notice to resign from management or go back to the floor as a Registered Nurse, the very next day was called in the office with another employee who also submitted her resignation. We were asked for our badges and keys then escorted out of the facility. Is this legal?

It may be. That's going to depend on whether or not there was some kind of contract or agreement existing between you and your employer. Indiana is an "at will" employment state. That means an employer can fire you for (1) good reason (2) bad reason or (3) no reason. The cannot fire you for an illegal reason. If you are fired for good reason, you have no recourse. If you are fired for a bad reason, your recourse is unemployment compensation. Sam with "no reason." An illegal reason is typically where you are fired for race, sex, age, religion or disability. There, you have a wide range of remedies available, including back pay, possible reinstatement, and even advancement. In you case, there is insufficient infomation to know whether you have any remedies. Once you submitted your resignation, the employer would have had the right to accept your resignation. If you somehow thought you had a right to go back onto the floor, that might give you some grounds, if you were deliberately misled, or if there was a contract, or if there is a union. Sometimes, a policy book can evidence an expectation wherein an employee can rely on the history of the company following that policy. You should consult with an Indiana attorney in your area.
