Legal Question in Medical Malpractice in Indiana

I was a patient of a doctor that is being charged with federal charges of medical malpractice. I did not file a malpractice suit on him, but one of his criminal charges is from my surgery. With a criminal trial, will I receive any kind of money compensation once he is convicted, or does compensation only come with a civil suit?

You will not receive any compensation from the criminal proceeding. Because the statute of limitations in Indiana typically requires you to file a civil claim within two years of the act of negligence, you should consult an attorney promptly to protect your right to bring a claim. Hello:Larry is correct that you would need to bring a civil suit in order to receive compensation. I suspect that I know who that doctor is and if I am correct, more than two years has passed since he would ahve iperated on you. However, if it is that doctor, you may be able to qualify as an exception to the 2 year statute. You need to talk with an attorney as soon as possible.
