Whether you get refinanced or not is not your seller's concern. You have a contract with him and it must be honored. He has no obligation to extend the contract. If you default in your payments, the contract should specify his rights as to taking back the house and whether you are entitled to any money back. It's not likely that you would be entitled to receive your down payment back.
