Legal Question in Bankruptcy in Iowa
Re-filing Chapter 7
My husband and I filed a Chapter 7 Bankruptcy in Iowa which was discharged in December 1997. My husband has now gotten himself in over his head financially and I am not involved in his present debts. He is considering filing Chapter 7 bankruptcy for himself only. Is there a time limit as to how long one must wait to file a second Chapter 7 Bankruptcy?

Yes, your husband would have to wait until 7 years after the first case was filed. If he feels that he cannot wait he would have the option to file a chapter 13 case and repay a percentage of his debts. Please feel free to call me to discuss this in more detail. ph (800) 303-0720
