Child Support

I have had custody of my 2 kids for 3 months. My husband has only been ordered to pay child support 1 of those months. He gave me a personal check for the exact ammt. last month & now attys. want me to sign a ''release & satisfy'' paper. I don't want to because I want to use that $ for the 2 months he didn't pay anything. Can I do that even though my lawyer does not think that I should? She also doesn't think that we should go after anything else for those 2 months that he didn't pay anything. Should I sign the paper or demand that I want to consider that check as a ''gift'' like the court would see it?

It's not a gift. Signing a release and satisfaction absolves your ex husband of any further responsibility on the debt. In essence you would be relinquishing any claim you might have to the other two months.

If that's all he was ordered to pay you're stuck unless you go after the other two months. Your lawyer thinks it imprudent. There's a difference of opinion there. She may have good reasons and you need to do a better job of communicating with her....I can't second guess her.
